India: TM Office issues public notice for extension of opposition deadlines till May 30, 2022

The Controller General of Patents, Designs, and Trade Marks (CGPDT) has issued a public notice dated March 28, 2022, regarding extension of opposition deadlines for trademarks registered during the pandemic. The notice has been issued in compliance with the recent order of the Delhi High Court (dated March 21, 2022), wherein the Court had suspended over 4 Lac trademark registration certificates granted during the Covid-19 pandemic.

According to the public notice, any person who wishes to file an opposition against any trademark published between November 18, 2019, and January 24, 2022 (both inclusive, irrespective of the status of the application, whether it be registered/opposed/accepted & advertised/advertised before acceptance) may submit the same with the Trade Marks Registry on or before the extended deadline of May 30, 2022.

For cases where trademark applications could not be opposed earlier due to the pandemic, we request you to kindly provide us with your instructions at your earliest convenience while keeping in mind the deadline of May 30, 2022.
